Welcome to Brainly. These Terms and Conditions (“Terms”) apply to all users of our chatbot development and automation services. By using our services, you agree to these Terms.

1. Services Provided

Brainly provides AI-powered chatbot development tailored to small and medium businesses. Services may include:

  • Collecting and using business information to train chatbots

  • Chatbot setup on supported platforms (e.g. website, Facebook, Instagram)

  • Lead form integration (Pro plan only)

  • Ongoing updates and support (depending on plan)

2. Plans and Pricing

We currently offer two standard plans:

Standard Plan

  • 1 platform (website or social media)

  • Up to 500 messages per month

  • $150 NZD one-time setup fee

  • $119 NZD per week subscription fee

Pro Plan

  • 3 platform total including

  • Facebook and Instagram platforms integrations

  • Lead collection form connected to Google Sheets

  • Up to 1,000 messages per month

  • $150 NZD one-time setup fee

  • $149 NZD per month subscription fee

Additional Message Usage

  • Extra usage beyond your plan’s monthly message limit will incur a charge of $25 NZD per 500 additional messages.

  • Clients will be notified when approaching their message limit and may choose whether to purchase credits.

3. Client Responsibilities

You agree to:

  • Provide accurate and approved information for chatbot training

  • Review and approve your chatbot before it goes live

  • Inform us of any required changes or issues promptly

You retain responsibility for how your chatbot represents your business once live.

4. Intellectual Property

Brainly retains the rights to the structure and logic behind the chatbot systems we build. You retain ownership of your original business content.

The chatbot created for your business is licensed for use only while your subscription is active.

5. Cancellations and Refunds

You may cancel your subscription at any time with 7 days’ notice.

  • Setup fees are non-refundable once the chatbot has been delivered or installed.

  • Weekly subscription payments already made are non-refundable.

6. Limitation of Liability

While we aim for reliability, Brainly is not liable for:

  • Loss of business due to technical issues, incorrect bot responses, or platform downtime

  • Miscommunication caused by the chatbot if based on client-provided or approved data

  • Any damages beyond the amount paid in the most recent billing cycle

7. Changes to These Terms

We may update these Terms occasionally. All changes will be posted on our website. Your continued use of the service indicates acceptance of any updates.
